Workers Compensation

Des Moines, Iowa Workers Compensation Lawyer

Job-Related Injuries occur everyday. Do you know your rights?

The Tucker Law Office focuses on helping employees who have been injured on the job and are due workers compensation. Most people aren't aware of their legal rights when they've been injured at work. The trouble is, if you've been injured, you need to know what your legal rights are, especially if there is some level of permanent loss - or you won't receive what is legitimately and legally due you. Attorney Robert E. Tucker, Ph.D., J.D., has nearly 20 years of successful experience in workers compensation law. He can help.

E-Mail or call 515-276-8282 or Toll Free 888-514-0254 or 515-238-9380 to reach Robert E. Tucker, Ph.D., J.D., for a free consultation about your workers compensation issues and to get an evaluation of your case.

Typical little-known but common ways that companies withhold money from you:

  • Did you know you are owed a paycheck while you recuperate from surgery due to work-related injuries? You are entitled to money during your healing period at home.
  • In the case of a head, neck , back, shoulder, hip or other "Body-as-a-Whole-type" injury, typically, your initial injury and recovery time may be only the beginning of your case. These sorts of injuries tend to be life-long, and greatly impact your everyday ability to function. You should know that you are to be compensated for future losses.
  • You need a lawyer to take into account your long-term earnings capacity and the loss of that capacity, because without a lawyer, your company and its insurance surely won't. How has your injury impacted your earning capacity (defined in Iowa Law as "ability to earn wages"-not actual wages earned)?
  • If you lost your job tomorrow, how difficult would it be for you to climb back into a job, given your, age, education, skill set, permanent impairment assigned by the doctor and permanent work restrictions? Now, how many weeks, months or years worth of workers' compensation benefits are due you?
  • A little-known benefit (and rarely explained by the Insurance Company) is your right to Mileage. Simply keep track of all Mileage to and from your job-related doctor appointments, physical therapy and Pharmacy visits and submit them to your Employer. By law, this Mileage MUST be paid. Lost time to attend these medical visits may also be paid.
  • Under Iowa Law, you are entitled to a 'Second Opinion' regarding your case. This doctor is chosen by you and paid for by the Employer. You will be paid Mileage for the trip to and from this doctor's office. Know your rights.

Tucker Law Office will assess your case and give you an estimate of the likely outcome.

Please E-Mail or call Attorney Robert E. Tucker, Ph.D., J.D., if you're unsure what your legal rights are and need answers. I can't bring back what you have lost, but I can make it easier.
