Product Liability

When you buy a new product, you expect it to work the way it's supposed to. Unfortunately, that doesn't always happen. Sometimes products break for no reason, or they're poorly designed or cheaply made. If you were injured because of a manufacturing or design defect or because the product did not have proper warnings, we can help protect your rights. At Tucker Law we have more than 30 years of experience representing clients in product liability cases in the state of Iowa.

Often a products liability case is closely tied to a workers' compensation matter or premises liability. Because we have experience handling a wide range of personal injury matters, we can help you receive the representation you need at every step of the process.

We thoroughly investigate every case to prepare it for trial and build the strongest case possible by taking photographs of the product, documenting injuries and calculating costs resulting from the injury. We primarily handle three categories of defective product cases, including:
  • Manufacturing defects: If a product is not properly assembled and fails during normal usage and injuries result, there may be grounds for a claim against the manufacturer. We represent clients injured by everything from defective ladders to defective medical devices.
  • Design defects: If a product is designed without adequate safety measures in place, it could be unsafe, even for normal use. We have successfully helped clients injured by design flaws affecting a variety of products, including heavy equipment and power tools.
  • Inadequate warnings: If an inherently dangerous product, for example, a snowblower, does not have sufficient warning to alert a consumer to possible injuries that could result from its use, the manufacturer could be liable. We're here to represent clients who were injured because a dangerous product did not come equipped with appropriate warnings.
